Crypto Card Services

1. INTRODUCTION
These Terms and Conditions (“Terms”) govern your access to and use of the Crypto Card services (“Service”), including the cryptocurrency-funded debit card (“Card”) provided by CryptoCard AG i.G. (“Company,” “we,” “us,” or “our”). The Card and related payment processing services are provided through our partnership with [Third Party Provider Name] (“Provider”), a licensed financial services provider.
By applying for, activating, or using the Card or Service, you agree to be bound by these Terms. Please read them carefully before using the Service.
2. ELIGIBILITY
To be eligible for the Service, you must:

- Reside in a jurisdiction where the Service is available
- Pass all required identity verification and anti-money laundering checks
- Maintain a valid crypto wallet with sufficient funds to use the Service
- Comply with all applicable laws and regulations
3. RELATIONSHIP WITH THIRD-PARTY PROVIDER
The Card is issued by [Third Party Provider Name] pursuant to a license from [Card Network Name] (e.g., Visa, Mastercard). [Third Party Provider Name] is a licensed financial institution responsible for:
- Card issuance and activation
- Payment processing
- Regulatory compliance
- Fraud monitoring and prevention

We act as a technology and service provider connecting your cryptocurrency assets to the Provider’s payment services. All banking services, money transmission, and fiat currency holdings are provided solely by the Provider, not by us.
4. ACCOUNT REGISTRATION AND VERIFICATION
To use the Service, you must:
- Create an account and provide accurate, complete, and up-to-date information
- Complete our know-your-customer (KYC) and anti-money laundering (AML) verification processes
- Link an eligible cryptocurrency wallet to your account
- Consent to ongoing monitoring as required by applicable regulations
We reserve the right to deny Service to anyone for any reason, including incomplete verification or suspected fraudulent activity.
5. CRYPTOCURRENCY FUNDING AND CONVERSION
The Card is funded through your linked cryptocurrency wallet. When you use the Card for purchases:
- The required amount of cryptocurrency is automatically converted to fiat currency at the then-current exchange rate
- Conversion fees may apply as detailed in our Fee Schedule
- Exchange rates are determined by the Provider and may fluctuate
- Once a transaction is initiated, it cannot be reversed or canceled
You acknowledge that cryptocurrency values may fluctuate significantly, and these fluctuations may affect your purchasing power.
6. FEES AND LIMITS
The following fees and limits may apply to your use of the Card:
- Card issuance fee
- Monthly/annual maintenance fee
- ATM withdrawal fees
- Foreign transaction fees
- Cryptocurrency conversion fees
- Inactivity fees
Additionally, the Card is subject to the following limits:
- Daily/monthly spending limits
- ATM withdrawal limits
- Funding amount limits
All applicable fees and limits are detailed in the Fee Schedule available on our website, which may be updated from time to time.
7. SECURITY AND UNAUTHORIZED TRANSACTIONS
You are responsible for:
- Keeping your account credentials, PIN, and Card details secure
- Notifying us immediately of any unauthorized use or suspicious activity
- Ensuring the security of your cryptocurrency wallet
While the Provider may offer certain fraud protections for Card transactions, these protections may differ from those available with traditional banking services. Please review the Provider’s terms for specific information about transaction dispute procedures.
8. RISKS AND DISCLAIMERS
By using the Service, you acknowledge and accept the following risks:
- Cryptocurrency price volatility may affect the value of your funds
- Regulatory changes may impact the availability or functionality of the Service
- Blockchain transaction delays may affect the timing of fund availability
- The Service may be unavailable during maintenance or due to technical issues
- Once executed, blockchain transactions cannot be reversed
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9. LIMITATIONS OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR THE PROVIDER SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for all claims related to the Service shall not exceed the greater of the amounts paid by you for the Service during the three months preceding the claim or $500.
10. CHANGES TO THE SERVICE OR TERMS
We may modify these Terms or any aspect of the Service at any time. We will provide notice of material changes through our website or via email. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.
11. TERMINATION
We reserve the right to suspend or terminate your access to the Service at any time for any reason, including but not limited to:
- Violation of these Terms
- Suspicious account activity
- Requirements from the Provider or regulatory authorities
- Service discontinuation
You may terminate your use of the Service by contacting customer support and following the provided instructions.
12. GOVERNING LAW AND DISPUTE RESOLUTION

You agree to indemnify, defend, and hold harmless the Company, the Provider, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the Service or violation of these Terms.
17. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
19. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
